Educational Travel Program
IMPORTANT: By making a reservation for this educational travel program, the Traveler ("you" or "your"), whether an adult participant and/or parent or legal guardian of a participant under the age of 18 ("minor"), acknowledges reading, understanding, and agreeing to be bound by the following terms and conditions to the maximum extent allowed by law.
OPERATING PARTIES: This tour is operated by Project Por Amor LLC ("PPA") and offered in partnership with the sponsoring organization ("Partner Organization" or "Sponsor"). These terms and conditions apply to and protect both PPA and the Partner Organization.
1. RESERVATIONS & PAYMENTS
Deposit: All reservations require a non-refundable deposit of $750 USD per person at the time of booking, payable to the Partner Organization or PPA as directed.
Final Payment: Full payment is due no later than 90 days prior to the tour departure date unless otherwise specified in writing by PPA or the Partner Organization.
Document Release: Travel documents, including but not limited to tickets, vouchers, and visas, will be retained until full payment is received.
Price Changes: All prices are based on rates in effect at the time of reservation acceptance and are subject to change due to currency fluctuations, fuel surcharges, taxes, or supplier cost increases. Any additional costs will be passed to the traveler with 30 days written notice.
2. CANCELLATIONS & REFUNDS
By Traveler:
120+ days before departure: Full refund minus $750 deposit per person
Less than 120 days before departure: No refund will be provided
Partial participation: No refund for unused portions of any tour
By Operator: PPA and/or the Partner Organization reserve the right to cancel any tour prior to departure due to insufficient enrollment, safety concerns, or other circumstances beyond reasonable control. In such cases, travelers will receive a full refund of all payments made.
No-Show Policy: Failure to join the tour at the designated time and place will be considered a cancellation without refund.
3. FORCE MAJEURE & EXTRAORDINARY CIRCUMSTANCES
Definition: Force Majeure includes but is not limited to: acts of God, natural disasters, war, terrorism, civil unrest, government actions, pandemics, epidemics, strikes, and other events beyond the reasonable control of PPA or the Partner Organization.
Cancellation Due to Force Majeure: In the event the tour must be cancelled due to Force Majeure circumstances within sixty (60) days of departure, full refunds are not guaranteed. PPA and the Partner Organization will make commercially reasonable efforts to:
Recover and refund payments already made to suppliers and vendors
Offer tour postponement to a mutually agreeable future date
Provide credit toward future travel programs
Any refund amount will depend on the ability to recover costs from suppliers and may be subject to cancellation fees imposed by third parties.
Travel Insurance Strongly Recommended: PPA and the Partner Organization strongly recommend purchasing comprehensive travel insurance from a third-party provider to protect your investment against cancellation, interruption, medical emergencies, and other unforeseen circumstances.
4. ESCROW PROTECTION
Client payments are deposited into separate accounts maintained apart from operating funds until approximately 60 days prior to departure when payments to suppliers become due.
5. INCLUSIONS & EXCLUSIONS
Included: All services specifically detailed in your tour itinerary and tour documents.
NOT Included:
Passport/visa fees (except Cuban tourist visas when specified)
Baggage fees and travel insurance
Personal expenses (laundry, phone, internet, minibar, etc.)
Meals, activities, or services not specified in the itinerary
Gratuities for guides, drivers, and local staff
Medical expenses and evacuation costs
Airport transfers unless specifically included
6. ACCOMMODATIONS & SUBSTITUTIONS
Accommodation Standards: While PPA and the Partner Organization strive to provide accommodations meeting reasonable standards, travelers acknowledge that international properties may differ from U.S. standards.
Substitutions: Due to infrastructure limitations, particularly in certain destinations, accommodations and services are subject to substitution. PPA will make reasonable efforts to provide comparable alternatives within the same category.
Room Assignments: Room preferences will be accommodated when possible but cannot be guaranteed. Neither PPA nor the Partner Organization is responsible for room conditions caused by infrastructure issues beyond reasonable control.
7. HEALTH & INSURANCE REQUIREMENTS
Travel Insurance: PPA and the Partner Organization strongly recommend comprehensive third-party travel insurance. Coverage should include trip cancellation/interruption, medical expenses, and emergency evacuation.
Destination Health Insurance: When required by destination countries, mandatory health insurance will be provided as part of tour costs.
Medical Fitness: Travelers must be in sufficient health to participate fully in tour activities and are responsible for disclosing any medical conditions that may affect participation.
8. LIABILITY LIMITATIONS & DISCLAIMERS
Agent Relationship: PPA acts as the tour operator, and the Partner Organization acts as the program sponsor. Both entities act solely as agents in arranging transportation, accommodations, and other travel services provided by independent suppliers. Neither PPA nor the Partner Organization maintains control over such suppliers' personnel, equipment, or operations.
Limited Liability: To the fullest extent permitted by law, BOTH PPA AND THE PARTNER ORGANIZATION disclaim liability for any injury, loss, damage, accident, delay, or expense arising from:
Acts or omissions of independent suppliers, their employees, or agents
Defects or failures in transportation, equipment, or accommodations
Acts of God, force majeure events, or circumstances beyond reasonable control
Traveler's failure to follow instructions or participate responsibly
Actions or decisions of tour leaders, guides, or other participants
Maximum Liability: The total liability of PPA and the Partner Organization, individually or collectively, for any claims shall not exceed the total amount paid by the traveler for the tour.
Indemnification: Travelers agree to indemnify and hold harmless both PPA and the Partner Organization from any claims, demands, losses, or expenses arising from the traveler's participation in the tour.
9. ASSUMPTION OF RISK
Voluntary Participation: Travelers voluntarily participate with full knowledge of inherent risks including but not limited to:
Transportation by various conveyances that may not meet U.S. safety standards
Travel in areas with limited medical facilities or emergency services
Exposure to different climates, altitudes, and environmental conditions
Political instability, civil disturbance, or terrorism
Infrastructure limitations and service interruptions
Risk of illness or injury in remote locations
Cultural differences and language barriers
Personal Responsibility: TRAVELERS EXPRESSLY ASSUME ALL RISKS associated with tour participation and agree to hold both PPA and the Partner Organization harmless from any resulting claims, damages, or expenses.
Physical Capability: Travelers certify they possess the physical and mental capacity required for tour participation and will comply with all instructions from authorized representatives of PPA and the Partner Organization.
10. OPTIONAL ACTIVITIES
Independent optional activities carry additional risks not controlled by PPA or the Partner Organization. Participation is entirely at the traveler's own risk, and both PPA and the Partner Organization disclaim all liability for such activities.
11. PHOTOGRAPHY & MEDIA CONSENT
Travelers grant both PPA and the Partner Organization perpetual, royalty-free rights to use photographs and videos taken during the tour for promotional and educational purposes. To opt out, written notice must be provided before tour departure to both organizations.
12. LEGAL COMPLIANCE
Applicable Laws: Travelers must comply with all applicable U.S., destination country, and international laws and regulations. Violation may result in immediate expulsion without refund.
Documentation: Travelers are responsible for obtaining and maintaining valid passports, visas, and other required documentation.
Educational Purpose: This tour is designed for educational and cultural exchange purposes. Travelers agree to participate in the spirit of learning and cultural understanding.
13. DISPUTE RESOLUTION
Governing Law: These terms are governed by California law without regard to conflict of law principles.
Jurisdiction: Any disputes shall be resolved exclusively in the courts of California.
Multiple Defendants: Travelers acknowledge that both PPA and the Partner Organization are protected parties under these terms. Any claims must name both entities to be considered properly filed.
Class Action Waiver: Travelers waive the right to participate in class action lawsuits against PPA and/or the Partner Organization.
Limitation Period: Any claims must be filed within one (1) year of the tour conclusion or the claim is forever barred.
14. PARTNER ORGANIZATION RELATIONSHIP
Brand Partnership: The Partner Organization sponsors and promotes this educational travel program under their brand in partnership with PPA as the tour operator.
Shared Protection: All liability limitations, assumption of risk provisions, and legal protections in these terms apply equally to both PPA and the Partner Organization.
Communication: Tour-related communications may come from either PPA or the Partner Organization, and travelers agree to work with both entities as needed.
15. GENERAL PROVISIONS
Severability: If any provision is deemed unenforceable, the remainder shall remain in full effect.
Entire Agreement: These terms constitute the complete agreement and supersede all prior negotiations or agreements.
Amendments: Changes must be in writing and agreed to by PPA and the Partner Organization.
Binding Effect: By making payment and/or participating in any tour under this program, travelers acknowledge reading, understanding, and agreeing to be bound by these terms and conditions as they apply to both PPA and the Partner Organization.
Survival: The provisions of liability limitation, assumption of risk, indemnification, and dispute resolution shall survive completion of the tour.
ACKNOWLEDGMENT: By proceeding with this reservation, the traveler acknowledges that they understand this is a partnership between the sponsoring organization and Project Por Amor LLC as tour operator, and that these terms and conditions protect both entities equally.
